Closed – consultation: Byelaws for Sites of Special Scientific Interest in England

Natural England has launched a consultation on its proposed approach to considering the use of its byelaw-making powers for the purpose of protecting Sites of Special Scientific Interest. The byelaw-making powers for this purpose are provided by Section 28R of the Wildlife and Countryside Act 1981 as amended by the Countryside and Rights of Way Act 2000.

Natural England is seeking to improve its capability to exercise these powers as part of its ongoing work to deliver proportionate and better regulation to further its Conservation Strategy and benefit the natural environment.

The consultation includes:

  • A set of proposed Operational Principles guiding Natural England’s approach to considering when it may recommend to the Secretary of State that a SSSI byelaw is made
  • A set of proposed Model SSSI Byelaws providing a standard format and content from which to draft any individual SSSI byelaws
  • A call for ideas and comments on how to encourage compliance with any future SSSI byelaws
